Car Rental Terms and Conditions

Introduction
This agreement sets forth the terms and conditions (“Terms”) governing the rental of vehicles by SelectDrive.co (“the Company,” “we,” “us,” or “our”) to the undersigned renter (“Renter,” “You,” or “Your”). By placing a reservation or utilizing the Services offered by SelectDrive.co in the Republic of Cyprus, You irrevocably accept and agree to be bound by these Terms. These Terms constitute a legally binding contract between the Renter and the Company.

1. Eligibility and Driver Requirements

• For vehicles with a market value not exceeding €25,000, only drivers who have attained the age of twenty-one (21) years and possess a valid driving license held for a minimum period of two (2) consecutive years are eligible for fully comprehensive insurance coverage. Third party liability insurance provisions may vary.
• For vehicles exceeding €25,000 in value, the driver must be aged between twenty-five (25) and seventy (70) years and maintain a valid driving license held continuously for no less than two (2) consecutive years to qualify for fully comprehensive insurance coverage. Third party liability terms may differ.
• All prospective drivers must obtain explicit prior written approval from the Company and be expressly authorized and documented in the Rental Agreement.
• Drivers shall adhere strictly to all applicable traffic laws and regulations in the Republic of Cyprus.
• The operation of vehicles in off-road conditions is strictly forbidden unless expressly authorized in writing by the Company. Any resultant damage arising from unauthorized off-road use shall be borne solely by the Renter.
• Vehicles are prohibited from being driven beyond the territorial jurisdiction of the Republic of Cyprus, including but not limited to Northern Cyprus, save where prior explicit written consent has been granted by the Company.

3. Rental Agreement

• The rental arrangement constitutes a contractual relationship solely between the Renter and SelectDrive.co.
• The Rental Agreement specifies the rental period, vehicle specifications, fees, and any special conditions and shall be executed at the time of vehicle collection.
• Execution of the Rental Agreement by the Renter constitutes unequivocal assent to all Terms herein and acknowledgment of the vehicle’s condition.
• The Company expressly reserves the right to refuse rental services or terminate the agreement without prior notice where the Renter breaches any provision of these Terms or where it deems such action necessary for legal, safety, or operational reasons.

3. Rental Period and Extensions

• The rental period shall commence and conclude at the times and locations mutually agreed upon and stipulated within the Rental Agreement.
• The Renter shall notify the Company in advance of any intention to extend the rental term and obtain prior consent from the Company; such extension is subject to availability and approval.
• Failure to return the vehicle punctually without prior notification shall entitle SelectDrive.co, at its sole and absolute discretion, to impose a surcharge commensurate with the severity and duration of the delay. This surcharge shall be calculated based on the scheduled rental rate for the vehicle category as well as any consequential losses or damages incurred by the Company arising from the delayed return.
• SelectDrive.co reserves the right to pursue all other legal remedies available, including but not limited to reporting the vehicle as stolen and initiating prosecution against the Renter for unauthorized possession or delay.

3. Vehicle Use Restrictions

• The vehicle is to be operated exclusively by authorized drivers and solely upon public roads.
• Use of the vehicle in connection with unlawful activities, motor racing, towing, or while under the influence of intoxicating substances is strictly prohibited.
• Use of the vehicle in connection with offloading is strictly prohibited unless explicitly agreed in writing
• Subleasing, lending, or any transfer of possession of the vehicle to third parties is expressly forbidden.
• Smoking within the vehicle is strictly prohibited.
• The Renter assumes full liability for all consequences arising from any contravention of these restrictions.

3. Payment and Deposits

• Payment shall be remitted via a credit or debit card registered in the name of the Renter, with sufficient funds available at the time of transaction.
• Cryptocurrency payments may be accepted at SelectDrive.co’s sole discretion, subject to prevailing conversion rates and terms determined by the Company.
  All deposits shall be made with stablecoins (USDC/USDT)
• A security deposit will be retained for the duration of the rental and returned upon satisfactory inspection of the vehicle post-rental.
• Rental fees encompass applicable taxes, compulsory insurance coverage, and service charges, with optional supplementary protections incurring additional fees.
• The Renter shall be solely responsible for the payment of all fines, penalties, or charges of any nature levied in connection with the use or possession of the rental vehicle during the rental period, including but not limited to parking violations, speeding fines, toll charges, or any other traffic infringement. In addition to the aforementioned fines, the Renter shall incur an administrative surcharge of ten euros (€10) per incident to cover costs associated with processing such fines.

3. Insurance and Liability

• Fully comprehensive insurance coverage applies exclusively if the driver satisfies the following criteria:
• Vehicles ≤ €25,000: Drivers aged between 21 and 70 years with at least 2 years of continuous valid driving license.
• Vehicles > €25,000: Drivers aged between 25 and 70 years with at least 2 years of continuous valid driving license.
• Additional drivers shall incur supplementary charges as stipulated by the Company.
• The Renter covenants and agrees to indemnify, defend, and hold harmless SelectDrive.co, its officers, employees, agents, affiliates, and assigns from and against all liabilities, claims, demands, damages, losses, expenses, costs (including reasonable attorneys’ fees), and penalties arising directly or indirectly from or relating to:
• The use, operation, or possession of the rental vehicle;
• Any breach of these Terms by the Renter or authorized drivers;
• Any negligent, reckless, or intentional acts or omissions of the Renter or authorized drivers;
• All third party claims or regulatory actions consequent to the Renter’s conduct.
• This indemnity clause is intended to be construed as broadly as legally permissible and shall survive the termination or expiration of the rental contract.
• Immediate notification to SelectDrive.co of any accident, damage, or loss is mandatory.

3. Cancellations and No-Shows

• Refunds in full shall be granted for cancellations made at least fifteen (15) days prior to the scheduled rental date.
• Cancellations communicated between seven (7) and fifteen (15) days prior to the rental date shall incur a charge of fifty percent (50%) of the rental fee.
• No-shows or cancellations with less than seven (7) days’ notice shall be liable for the full rental amount.
• SelectDrive.co reserves the unqualified discretion to accept, modify, or cancel reservations consistent with these Terms.

3. Vehicle Condition and Return

• Vehicles are delivered in a clean, fully operational, and insured state, accompanied by appropriate documentation.
• The Renter must inspect the vehicle upon receipt and report any pre-existing damage to the Company.
• The vehicle must be returned in the condition received and with the agreed fuel level; failure to comply shall result in applicable charges.
• Costs arising from new damages, missing accessories, excessive cleaning, or delayed returns will be charged to the Renter.

3. Data Protection

• SelectDrive.co collects, processes, and stores personal data strictly in accordance with all applicable data protection laws, including but not limited to the European Union’s General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679) and the Republic of Cyprus’s Law 125(I)/2018 on Data Protection.
• Personal data may include identification, contact, financial, and driver’s license information necessary to fulfill contractual and legal obligations.
• By entering into this Agreement, the Renter consents to such data processing and to the sharing of personal data with third-party service providers, insurance companies, and regulatory authorities as legally required or operationally necessary.
• SelectDrive.co undertakes to implement reasonable administrative, physical, and technical safeguards to protect personal data.
• The Company disclaims liability for data breaches or unauthorized access beyond its reasonable control.
• The Renter retains rights to access, correct, or request deletion of personal data, subject to legal or operational restrictions.
• This clause is drafted expansively to ensure protection of SelectDrive.co’s interests.

3. Amendments and Governing Law

The parties irrevocably submit to the exclusive jurisdiction of the competent courts of Cyprus for any dispute arising out of or relating to this Agreement.

SelectDrive.co reserves the right to modify, amend, or update these Terms periodically. Continued use of Services after notification constitutes acceptance of the revised Terms.

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Cyprus.
